RECEIVED: PM 11/10/23

On application of Robert Calvin Farris for POST CONVICTION RELIEF in No. 312,121 on the docket of the First Judicial District, Parish of CADDO, Judge John D. Mosely, Jr.

Rachel Isabel Conner Counsel for: Robert Calvin Farris

James Edward Stewart, Sr. Suzanne Morelock Ellis Counsel for: State of Louisiana

Before COX, HUNTER, and ELLENDER, JJ.

WRIT DENIED .

The applicant, Robert Farris, seeks supervisory review of the trial court's June 6, 2023, ruling denying his application for post-conviction relief. Farris' claim asserting that he was denied effective assistance of counsel was filed more than two years after his convictions and sentences became final, and Farris failed to establish that any exception to the time limit applied to this claim. La.C.Cr.P. art. 930.8. Farris' claim of factual innocence pursuant to La.C.Cr.P. art. 926.2 was timely filed; however, he failed to present the type of evidence that complies with the criteria established in the statute as necessary to obtain relief under the factual innocence statute. La.C.Cr.P. art. 926.2. Accordingly, on the showing made, the writ is denied.
