State v. Evans

District Court of Appeal of Florida, Second District
Feb 18, 2000
752 So. 2d 78 (Fla. Dist. Ct. App. 2000)

Opinion

No. 2D99-2457.

Opinion filed February 18, 2000.

Appeal from the Circuit Court for Pinellas County; Brandt C. Downey, III, Judge.

Robert A. Butterworth, Attorney General, Tallahassee, and Wendy Buffington, Assistant Attorney General, Tampa, for Appellant.

James Marion Moorman, Public Defender, and Allyn Giambalvo, Assistant Public Defender, Bartow, for Appellee.

We affirm Larry Evans' convictions and sentences. Although Evans was charged with three criminal offenses and entered guilty pleas to all three, the judgment fails to reflect the court's adjudication on counts two and three. Accordingly, we remand with directions to the trial court to correct the written judgment to reflect that Evans pleaded guilty to all three charged offenses.

BLUE, A.C.J., and FULMER and DAVIS, JJ., Concur.
