Opinion

No. 00-KK-0373.

October 27, 2000.

ON WRIT OF CERTIORARI TO THE COURT OF APPEAL FOURTH CIRCUIT, PARISH OF ORLEANS.

Hon. Richard P. Ieyoub, Attorney General, Hon. Harry F. Connick, District Attorney, Sanem Ozdural, Esq., Counsel for Applicant.

Patrick Hillary Hufft, Esq., Counsel for Respondent.

Upon the State of Louisiana's application, we granted certiorari in this case. State v. Duplechain, et al., 2000 WL 783381 (La. 6/2/00). After hearing oral argument and reviewing the record in this case, we conclude that the judgment below does not require the exercise of our supervisory authority. Accordingly, we recall our order of June 2, 2000, as improvidently granted, and deny the State's application.
