Opinion

No. 20010257

Decided May 14, 2002

Appeal from the District Court of Pembina County, Northeast Judicial District, the Honorable Laurie A. Fontaine, Judge.

AFFIRMED.

Barbara L. Whelan, State's Attorney, 301 Dakota Street West, #9, Cavalier, N.D. 58220, for plaintiff and appellee; submitted on brief.

Coral Joan Mahler, 3159 Highway 281, Sheyenne, N.D. 58374, for defendant and appellant; submitted on brief.

NOTE: SUMMARY OPINION, SEE NORTH DAKOTA RULES OF APPELLATE PROCEDURE, RULE 35.1.

[¶ 1] Keith Disbrow appealed from judgments of conviction, upon jury verdicts finding him guilty on six counts of gross sexual imposition for sexually abusing two minor children. We affirm the judgments under N.D.R.App.P. 35.1(a)(1). This opinion is entered, however, without prejudice to Disbrow's right to bring a subsequent petition for post-conviction relief on the ground of ineffective assistance of counsel.

[¶ 2] Gerald W. VandeWalle, C.J.

Dale V. Sandstrom

Carol Ronning Kapsner

Mary Muehlen Maring

William A. Neumann
