State v. Dewitt

Court of Appeals of Iowa
Dec 24, 2003
796 N.W.2d 456 (Iowa Ct. App. 2003)

Opinion

No. 3-829 / 02-1560.

Filed December 24, 2003.

Appeal from the Iowa District Court for Johnson County, William L. Thomas (Trial) and Thomas M. Horan (Motion to Supress), Judges.

Defendant appeals the denial of two motions to suppress. AFFIRMED.

Patrick Ingram of Mears Law Office, Iowa City, for appellant.

Thomas J. Miller, Attorney General, Karen Doland, Assistant Attorney General, J. Patrick White, County Attorney, and Michael Brennan, Assistant County Attorney, for appellee.

Considered by Vogel, P.J., and Hecht and Vaitheswaran, JJ.

Three companion cases involving other members of the Dewitt family were decided with opinions filed on November 26, 2003. Each discuss and decide the very issue upon which Robert Eugene Dewitt, Sr. now appeals. Consistent with the prior opinions of this court and upon a finding that the searches were based on Dewitt's verbal and written consent, we affirm without further opinion that the motions to suppress were properly overruled. Iowa R. App. P. 6.24. See State v. Dewitt, No. 02-1460 (Iowa Ct. App. Nov. 26, 2003); State v. Dewitt, No. 02-1379 (Iowa Ct. App. Nov. 26, 2003); State v. Dewitt, No. 02-1465 (Iowa Ct. App. Nov. 26, 2003).

On December 17, 2003, Dewitt filed a motion requesting oral argument. We deny that request as untimely. See Iowa R. App. P. 6.21(1).

AFFIRMED.
