STATE OF LOUISIANA v. COREY DANIELSON


In Re: Stare of Louisiana, applying for supervisory writs, 19th Judicial District Court, Parish of East Baton Rouge, No. 12-13-0961. BEFORE: GUIDRY, HOLDRIDGE AND CHUTZ, JJ.

WRIT GRANTED. The district court's ruling granting the defendant's motion to quash is reversed, and this matter is remanded to the district court tor further proceedings. Neither rhe two-year time limitation for institution of prosecution nor the one-year time limitation for commencement of trial had expired at the time the defendant's motion to quash was filed. See La. Code Crim. P. arts. 572(3), 578(3), & 580A.
