STATE OF LOUISIANA v. TYRONE CHERAMIE


In Re: State of Louisiana, applying for supervisory writs, 17th Judicial District Court, Parish of Lafourche, Nos. 569172 & 569173. BEFORE: WHIPPLE, C.J., McCLENDON AND HIGGINBOTHAM, JJ.

WRIT GRANTED. Pursuant to La. Code Crim. P. art. 895(A)(4), the officer had the right to visit defendant at his home to conduct a compliance check. Prior to the seizure of the evidence, the items observed in plain view provided a means of securing probable cause for the search warrant. See La. Code Crim. P. art. 162(A). Accordingly, we find merit in the State's contention that the lower court erred in granting the motion to suppress. Therefore, the lower court's ruling is reversed and this matter is remanded for further proceedings.
