Appellant, the State of Texas, by and through the Assistant District Attorney in and for Nueces County, Texas, has filed a motion for stay of proceedings in the above cause. On August 20, 2015, the trial court granted a new trial in trial court cause 07-CR-4048-E.

The State has filed a notice of appeal in this cause and has requested that all further proceedings be stayed pending disposition of its appeal. See TEX. CODE CRIM. PROC. ANN. art. 44.01(a)(3), (e) (West, Westlaw through 2015 R.S. 2015). The Court, having examined and fully considered the motion for stay of proceedings, is of the opinion that said motion should be granted. The motion for stay is hereby GRANTED, and the trial court's proceedings in this cause is hereby ordered STAYED pending disposition of the State's appeal.
