State v. Carmouche

Supreme Court of Louisiana
Dec 2, 1977
352 So. 2d 704 (La. 1977)

Opinion

No. 60970.

December 2, 1977.

IN RE: LOUIS J. CARMOUCHE, APPLYING FOR WRITS OF CERTIORARI, PROHIBITION, MANDAMUS AND FOR STAY ORDER.

Writ denied. There is some evidence to support probable cause for the arrest. This Court does not weigh the sufficiency of the evidence.

DIXON, J., dissents. The attempted arrest by the officer was clearly unjustified.

CALOGERO, J., is of the opinion the writ should be granted.
