In re: H. M. "Mike" Cannon, applying for writs of review, mandamus, certiorari and stay order. Parish of E. Baton Rouge, Number 7-79-451.


Writ granted. Ruling of trial judge reversed and set aside.

TATE, J., concurs. However, he is of the view that the district attorney is not barred from responding publicly to personal charges made against him which are independent of the present prosecution.

In view of the concurrence of Justice TATE, DIXON, J., notes that he is in agreement with the action of the majority and is further of the opinion that it would be risky and unwise for the District Attorney to resort to public statements relating to a defendant in a case being prosecuted.
