¶ 1 Review in this matter was granted by Department II of the Court by order dated July 11, 2012, and thereafter the matter was set for oral argument on October 23, 2012. This matter came before the Court on its October 11, 2012, En Banc Conference for additional consideration, and the Court having unanimously determined that review in this matter was improvidently granted, and that oral argument set for October 23, 2012, should be stricken, the following order should be entered:
