APPEALS ACCEPTED FOR REVIEW.

Upon consideration of the jurisdictional memoranda filed in this case, the court accepts the appeal. The clerk shall issue an order for the transmittal of the record from the Court of Appeals for Cuyahoga County. The clerk for the Court of Appeals for Cuyahoga County shall transmit the record immediately and without delay.

It is ordered by the court that the briefing in this case shall be expedited. Appellant shall file its merit brief no later than Friday, September 4th, appellee shall file his merit brief no later than Tuesday, September 8th, and appellant may file a reply brief no later than Wednesday, September 9th. The briefs and any future documents in this case shall be served by personal, facsimile, or e-mail transmission.

No requests for extensions of time shall be permitted, and the clerk shall refuse to accept for filing a request for extension of time.

PFEIFER and O'DONNELL, JJ., would not order expedited briefing.
