State v. Blount

Supreme Court of Louisiana
Apr 15, 1977
344 So. 2d 378 (La. 1977)

Opinion

No. 59679.

April 15, 1977.

IN RE: WILLIAM YANDA APPLYING FOR WRITS OF CERTIORARI, PROHIBITION, MANDAMUS AND STAY ORDER.

Writ refused. We find no constitutional violation in the ruling complained of. See prior application, State v. Yanda, La., 339 So.2d 847. In any event, there is an adequate remedy by appeal.

SUMMERS and CALOGERO, JJ., are of the opinion the writ should be granted.

DIXON, J., is of the opinion the writ should be granted, not understanding how the right of defendant to remain silent is not violated.

DENNIS, J., concurs for the reason that defendant has an adequate remedy by appeal.
