STATE OF LOUISIANA v. DANIEL BARRIOS, II


In Re: Daniel Barrios, II, applying for supervisory writs, 17th Judicial District Court, Parish of Lafourche, Nos. 535642; 539749; 539865; 539899; & 545984. BEFORE: HIGGINBOTHAM, THERIOT, AND CHUTZ, JJ.

WRIT GRANTED. Indigent inmates must be provided with free copies of certain documents such as the transcripts of guilty plea colloquies, the bill of information charging them with committing a crime, district court minutes for various portions of their trials and documents committing them to custody without showing a particularized need. See State ex rel. Simmons v. State, 93-0275 (La. 12/16/94), 647 So.2d 1094, 1095 (per curiam). Therefore, the district court erred by denying relator's motion for production of documents, filed November 10, 2016. Accordingly, the ruling on the motion is reversed, this matter is remanded, and the district court is ordered to provide relator with a free copy of the July 19, 2016, Boykin transcript, the bills of information for docket numbers 539749, 539899 and 545984, the district court minutes of the sentencing, and the commitment order, if the court has not done so already. A copy of the district court's action shall be filed in this Court on or before April 25, 2017.
