Opinion

No. 54132-3-I

Filed: August 1, 2005 UNPUBLISHED OPINION

Appeal from Superior Court of King County. Docket No: 03-8-03021-1. Judgment or order under review. Date filed: 03/25/2004. Judge signing: Hon. Michael J. Fox.

Counsel for Appellant(s), Nancy P. Collins, Washington Appellate Project, 1511 3rd Ave Ste 701, Seattle, WA 98101-3635.

Counsel for Respondent(s), Amy R. Holt, King County Prosecutor's Office, 516 3rd Ave Ste W554, Seattle, WA 98104-2390.

A.N. appeals his juvenile court conviction for unlawful possession of a firearm, arguing that he was entitled to have a jury determine his guilt under recent United States Supreme Court decisions and the Washington State Constitution.

Blakely v. Washington, 542 U.S. 296, 124 S. Ct. 2531, 159 L. Ed. 2d 403 (2004), Apprendi v. New Jersey, 530 U.S. 466, 120 S. Ct. 2348, 147 L. Ed. 2d 435 (2000), and Crawford v. Washington, 541 U.S. 36, 124 S. Ct. 1354, 158 L. Ed. 2d 177 (2004).

A.N.'s arguments relating to the recent United States Supreme Court decisions were rejected in, and are controlled by, our decision in State v. Tai N., ___ Wn. App. ___, 113 P.3d 19 (2005). His argument relating to the state constitution challenges State v. Schaaf, 109 Wn.2d 1, 743 P.2d 240 (1987), a decision that is binding on this court. Accordingly, his argument must be addressed to our State Supreme Court.

Affirmed.

COLEMAN, AGID, and BAKER, JJ.
