Following a bench trial, defendant was convicted of driving while his license was suspended as the result of a driving while intoxicated conviction, N.J.S.A. 39:3-40; failure to exhibit a valid license, N.J.S.A. 39:3-29; and failure to report a change of address, N.J.S.A. 39:3-36(a). The underlying summonses were issued to defendant after a police officer observed defendant driving north on Chestnut Ridge Road in Montvale on September 9, 2011. In this appeal, defendant raises the following issues:
POINT I
THE POLICE OFFICER'S FAILURE TO INCLUDE THE CORRECT LOCATION WHERE THE ALLEGED MOTOR VEHICLE OFFENSE OCCURRED AMOUNTS TO A "FATAL ERROR" BECAUSE ALVAREZ WAS UNABLE TO PREPARE A PROPER DEFENSE (PARTIALLY RAISED BELOW).
POINT II
THE STATE HAS FAILED TO PROVE THAT ALVAREZ WAS OPERATING HIS MOTOR VEHICLE IN VIOLATION OF N.J.S.A. 39:3-40, AS THE STATE'S EVIDENCE WAS FLAWED (PARTIALLY RAISED BELOW).
After reviewing these arguments in light of the record and applicable principles of law, we conclude that neither argument has sufficient merit to warrant discussion in a written opinion. R. 2:11-3(e)(2).
