ORDER GRANTING MOTION TO DISMISS APPEAL

Upon consideration of Defendant's Request to Dismiss Criminal Appeal Pursuant to Hawaii Rules of Appellate Procedure, Rule 42(c) (motion), filed August 23, 2023, by Defendant- Appellant Sean Aldan (Aldan), the papers in support, and the record, and there being no opposition, it appears that (1) the appeal was docketed on April 20, 2023; (2) pursuant to Hawai i Rules of Appellate Procedure (HRAP) Rule 42(c), Aldan requests that the appeal be dismissed; (3) the motion includes Aldan's declaration showing he understands the consequences of voluntary dismissal, consistent with HRAP Rule 42(c); and (4) dismissal is authorized by HRAP Rule 42(b) and (c).

Therefore, IT IS HEREBY ORDERED that the motion to dismiss the appeal is granted, and the appeal is dismissed.
