IN RE: FREDDIE MARTIN APPLYING FOR WRITS OF HABEAS CORPUS AND CERTIORARI.


Writ refused. Because of emergency situation at Orleans Parish prison, the detention at Angola has been allowed. See No. 53,953, State ex rel. Mathews v. Henderson, La., 292 So.2d 496.

BARHAM, J., and TATE, J., are of the opinion the writ should be granted.

DIXON, J., is of the opinion that conditions which existed in Mathews v. Henderson were of a temporary nature, and must be corrected. An evidentiary hearing should have been held.
