No. 2020-CK-00677

STATE of Louisiana IN the INTEREST OF L.S.

Writ application granted. See per curiam.

Hughes, J., would deny.

PER CURIAM.

On Supervisory Writ to the Juvenile Court, Parish of Orleans Criminal WRIT GRANTED. The Orleans Parish Juvenile Court erred in revoking L.S.’s probation. The judgment of February 5, 2020 contains express conditions of probation which include, in part, that "[i]f the youth is arrested for any offense between now and August 4, 2020, the Court will find the youth is in contempt of court and jail him for five days." Thus, the foregoing was the appropriate sanction to be imposed for the subsequent arrest of L.S. Revocation of L.S.’s probation absent a conviction was therefore an abuse of discretion.

Accordingly, the ruling of the Orleans Parish Juvenile Court revoking L.S.’s probation is reversed. This Court finds that L.S. is in contempt of court subjecting him to five days in jail. L.S. is to be given credit for time served. This matter is remanded to the Orleans Parish Juvenile Court for further proceedings and compliance herewith.
