State, Hammock v. Kennedy

District Court of Appeal of Florida, First District
Jan 21, 1965
170 So. 2d 332 (Fla. Dist. Ct. App. 1965)

Opinion

No. G-80.

December 31, 1964. As Corrected January 4, 1965. Rehearing Denied January 21, 1965.

Appeal from the Circuit Court for Gulf County; Robert L. McCrary, Jr., Judge.

Ervin, Pennington Varn, Tallahassee, for appellant.

Ben F. Barnes, Marianna and David C. Gaskin, Wewahitchka, for appellee.

It appears upon consideration of this appeal from an order dismissing a petition for writ of quo warranto that the relator has failed to clearly demonstrate an entitlement to the writ. So, denial of the petition is affirmed.

STURGIS, C.J., and CARROLL, DONALD K. and RAWLS, JJ., concur.
