Opinion

No. 57640.

March 12, 1976.

IN RE ROOSEVELT WILLIAMS APPLYING FOR WRIT OF MANDAMUS.

Writ denied. Trial judge acted on relator's motion on January 23, 1976. The matter is moot.

DIXON, J., concurs in the denial; the return of the trial judge reflects that an extension was granted to perfect the appeal, but it has expired (60 days after Dec. 22.) Since the mandamus has been acted on, the applicant must institute proceedings to take an out-of-time appeal if the time granted to perfect the appeal has expired.
