In re James Joseph Tassin, applying for writ of mandamus. Parish of Avoyelles.


Writ denied. There is no record in the trial court of any motion for a new trial filed by the relator on May 11, 1978, as alleged. Moreover, the minutes show that the relator pleaded guilty on that day and, after waiving any delay, was immediately sentenced. Cf. La.C.Cr.P. art. 853, requiring motion for new trial to be filed before sentence.
