State ex Rel. Gray v. Henderson

Supreme Court of Louisiana
Dec 19, 1973
286 So. 2d 658 (La. 1973)

Opinion

No. 54150.

December 19, 1973.

IN RE: JOSEPH GRAY, JR. APPLYING FOR WRITS OF MANDAMUS AND HABEAS CORPUS.

Writ denied. The trial judge having, by his return, stated that the application below was denied on November 14, 1973, this application to mandamus him to act is now moot.

BARHAM, J., concurs. This is another occasion where this jurisdiction (24th Judicial District Court) has failed to act on a writ application for an unduly length of time contrary to positive law. The delay here was six months. This Court should not countenance this procedure.
