State, Department of Highways v. Ourso

Supreme Court of Louisiana
Aug 28, 1974
299 So. 2d 358 (La. 1974)

Opinion

No. 54970.

August 28, 1974.

IN RE: E. J. OURSO, ANDREW J. FALCON, ADELINE D. BLUM AND BARBARA BLUM ARMSTRONG APPLYING FOR CERTIORARI, OR WRIT OF REVIEW, TO THE COURT OF APPEAL, FIRST CIRCUIT, PARISH OF ASCENSION.

Writ denied. Under the facts we find no error of law in the Court of Appeal opinion.

SUMMERS, J., dissents from the refusal to grant writs. It is implicit from the undisputed facts that severance damage did in fact result to the property of defendants.
