On November 20, 2023, Appellee Chappell Hill Construction, Co. filed a Third Unopposed Verified Motion to Extend Time to File Appellee's Brief. Citing a family emergency, Appellee requested this Court grant a third extension postponing the deadline for Appellee to file its brief seven days from November 20, 2023 to November 27, 2023. Appellee, however, did not file his brief by the requested extension date of November 27, 2023. Rather, on November 28, 2023, he filed a Fourth Unopposed Verified Motion to Extend Time to File Appellees' Brief seeking an extension through December 4, 2023, to file its brief.
Appellee's Third Unopposed Motion is denied as moot. Appellee's Fourth Unopposed Motion is granted. Appellee's brief is due on December 4, 2023. If Appellee's brief is not timely filed, the appeal may be submitted without an Appellee's brief. See, e.g., Saldana v. Hinojosa, 517 S.W.3d 239, 240 n.1 (Tex. App.-San Antonio 2017, no pet.). No further extensions will be granted.
