Stanley Furniture v. Corliss

District Court of Appeal of Florida, First District
Aug 26, 1980
387 So. 2d 491 (Fla. Dist. Ct. App. 1980)

Opinion

No. RR-24.

August 26, 1980.

Appeal from an order of a Judge of Industrial Claims; Arthur S. Seppi, Judge.

Frank E. Maloney, Jr., and Anthony J. Beisler, Fort Lauderdale, for appellants.

Emil Jaczynski, Fort Lauderdale, for appellee.

The judge's order is affirmed except as to the payment of Dr. Stuart's bill and the finding that the employer/carrier controverted the claim.

Appellee admits that no request was made for payment of Dr. Stuart's bill and that the employer/carrier never controverted the claim. Pursuant to this confession of error, we reverse the order as to these points.

ERVIN and SHAW, JJ., and WOODROW M. MELVIN (Ret.), Associate Judge, concur.
