STIPULATED REQUEST FOR DISMISSAL


Pursuant to Rule 41(a)(1)(ii) of the Federal Rules of Civil Procedure, Plaintiff, ST. PAUL FIRE AND MARINE INSURANCE COMPANY and Defendant L1EBHERR-WERK BIBERACH GmbH ("LIEBHERR") in the above-captioned lawsuit, hereby request that this matter be dismissed with prejudice, each party to bear its own costs, in accordance with the terms of an agreement between Plaintiff ST. PAUL FIRE AND MARINE INSURANCE COMPANY and Defendant LIEBHERR.

Further, Third Party Plaintiff LIEBHERR and Third Party Defendants McCOY ELECTRIC and H. LYNN McCOY hereby request that this matter be dismissed with prejudice, each party to bear its own costs, in accordance with the terms of an agreement between LIEBHERR and McCOY ELECTRIC and H. LYNN McCOY.

Further, Third Party Plaintiff LIEBHERR and Third Party Defendant LEWIS CRANE HOIST, INC. hereby request that this matter be dismissed with prejudice, each party to bear its own costs, in accordance with the terms of an agreement of the parties.

Further, Third Party Plaintiff LEWIS CRANE HOIST, INC. and Third Party Defendant WEBCOR BUILDERS, INC. hereby request that this matter be dismissed with prejudice, each party to bear its own costs, in accordance with the terms of an agreement between LEWIS CRANE HOIST, INC. and WEBCOR BUILDERS, INC.

It is intended that this Stipulated Request for Dismissal dismiss the entire action with prejudice, with each party to bear costs in accordance with the terms set forth above.

Further, Third Patty Plaintiff LIEBHERR and Third Party Defendants McCOY ELECTRIC and H. LYNN McCOY hereby request that this matter be dismissed with prejudice, each patty to bear its own costs, in accordance with the terms of an agreement between LIEBHERR and McCOY ELECTRIC and H. LYNN McCOY.

Further, Third Party Plaintiff LIEBHERR and Third Party Defendant LEWIS CRANE HOIST, INC. hereby request that this matter be dismissed with prejudice, each, party to bear its own costs, in accordance with the terms of an agreement of the parties.

Further, Third Party Plaintiff LEWIS CRANE HOIST, INC. and Third Party Defendant WEBCOR BUILDERS, INC, hereby request that this matter be dismissed with prejudice, each party to bear its own costs, in accordance with the terms of an agreement between LEWIS CRANE HOIST, INC. and WEBCOR BUILDERS, INC.
