ORDERED that the motion to dismiss the appeal taken by notice of appeal dated August 25, 2016 and for further relief is denied, without costs, and without prejudice to the issues advanced in support of dismissal being raised upon the argument of the appeal, and the motion is, in all other respects, denied, and it is further
ORDERED that the cross motion is denied, without costs, as academic.
