JUDGMENT


In light of the order dated December 12, 2002, any judgments on the record, plaintiffs voluntary withdrawals, and the jury special verdict returned on February 7, 2003, and for the reasons stated therein, judgment is ENTERED in favor of defendants Jenner Biotherapies Inc. and Hayden Leason and against plaintiff Dr. Spitler on all claims except the following:

1.) Judgment is ENTERED in favor of plaintiff and against defendant Hayden Leason, on plaintiffs claim for breach of fiduciary duty, in the amount of three hundred fifty thousand dollars ($350,000).
2.) Judgment is ENTERED in favor of plaintiff and against defendant Jenner, on plaintiffs claim for breach of the California labor code (which claim has now been fully paid).

IT IS SO ORDERED.
