Opinion

Nos. 2D12–755 2D11–6455.

2012-10-16

Roy Lee SPEIGHTS, Appellant/Petitioner, v. STATE of Florida, Appellee/Respondent.

BY ORDER OF THE COURT.

In case number 2D12–755, Roy Lee Speights has appealed an order denying his “motion to strike financial obligation agreement.” This issue related to costs apparently imposed on Mr. Speights for the preparation of the record in case number 2D11–6455.

We dispose of this appeal in the same manner that we employed in Williams v. State, No. 2D11–5594 (Fla. 2d DCA Oct. 5, 2012). The appeal in case number 2D12–755 is treated as a motion for review in case number 2D11–6455, and case number 2D12–755 is dismissed as duplicative.

The motion for review is granted. For the same reasons explained in Williams, the order denying the motion to strike financial obligation agreement is quashed, and the motion to strike is remanded to the trial court for further proceedings consistent with this order and the opinion in Williams.
