Spectrum Interiors, Inc. v. Northshore Ocean Hammock

District Court of Appeal of Florida, Fifth District
Dec 30, 2005
917 So. 2d 377 (Fla. Dist. Ct. App. 2005)

Opinion

Nos. 5D05-1874, 5D05-1909.

December 30, 2005.

Appeal from the Circuit Court for Flagler County, Kim C. Hammond, Judge.

Robert E. Pershes, Scott J. Topolski and H. Michael Muniz of Buckingham, Doolittle Burroughs, LLP, Boca Raton, for Appellants.

Don Niesen and Michael F. Blakey of The Robertson Group, Gainesville, for Appellee, Exterior Walls, Inc.

Guy Harrison, Edward Etcheverry and Jeffrey S. Geller of Etcheverry Harrison, LLP, Fort Lauderdale, for Appellee, RLI Insurance Co.

No Appearance for Appellee, Northshore Ocean Hammock.

We affirm the orders of the trial court denying Appellants' motions to compel arbitration. The appeal of the May 16, 2005 order granting RLI Insurance Co.'s Motion to Dismiss the Complaint with Prejudice, dated August 5, 2004, is dismissed because the order is a non-final, non-appealable order. Dedge v. Crosby, 914 So.2d 1055 (Fla. 1st DCA 2005); EIR, Inc. v. Electronic Molding Corp., 540 So.2d 260 (Fla. 5th DCA 1989).

ORFINGER and TORPY, JJ., and GURROLA, B., Associate Judge, concur.
