Opinion

No. SC13–1736.

Tommy SPAN, Petitioner(s) v. STATE of Florida, Respondent(s).

Rehearing Denied June 13, 2014.

The petitioner has filed a petition for writ of mandamus with the Court. To the extent the petitioner seeks a writ of mandamus, the petition is denied for failure to show a clear legal right to the relief sought. See Huffman v. State, 813 So.2d 10, 11 (Fla.2000). To the extent the petitioner seeks the type of relief available in a motion filed pursuant to Florida Rule of Criminal Procedure 3.850, the petition is dismissed as unauthorized. See Baker v. State, 878 So.2d 1236 (Fla.2004). Any motions or other requests for relief are also denied.
