An appeal having been taken to this Court by petitioner-appellant from an order of the Supreme Court, New York County, entered on or about January 13, 2016, And said appeal not having been brought on for hearing pursuant to the provisions of the Rules of Practice of the Appellate Division, First Department, And correspondence from petitioner-appellant, dated May 24, 2018, having been received by the Clerk of the Court stating their intention not to perfect the appeal for argument, And a calendar call having been held by the Clerk of the Court on May 31, 2018, pursuant to Rule 600.12(c) of said Rules of Practice, Now, upon the Court's own motion, It is ordered that the appeal is dismissed.
