Opinion

Case No. 20060518-CA.

Filed September 8, 2006. (Not For Official Publication).

Appeal from the Second District, Ogden Department, 030907005, The Honorable W. Brent West.

William A. Ward, Ogden, Appellant Pro Se.

Before Judges Davis, McHugh, and Orme.

MEMORANDUM DECISION

William A. Ward seeks to appeal certain determinations made during the trial court's May 10, 2006 order to show cause hearing. This matter is before the court on its own motion for summary disposition.

Appeals may be taken only from final orders or judgments. See Utah R. App. P. 3(a). Aside from certain exceptions not applicable here, an appellate court "does not have jurisdiction over an appeal unless it is taken from a final judgment."Loffredo v. Holt, 2001 UT 97, ¶ 10, 37 P.3d 1070. It is well settled that an unsigned minute entry is not a final order for purposes of appeal. See Ron Shepard Ins. v. Shields, 882 P.2d 650, 653 (Utah 1994). Here, there is not even an unsigned minute entry, but only a transcript from a hearing. Thus, there is no final order for purposes of appeal.

When this court lacks jurisdiction it must dismiss the appeal.See Loffredo, 2001 UT 97 at ¶ 11. Accordingly, Ward's appeal is dismissed.

James Z. Davis, Judge, Carolyn B. McHugh, Judge and Gregory K. Orme, Judge, concur.
