Nos. 125218, 125219. The Court of Appeals remanded this case for further proceedings on plaintiffs' vicarious liability claim against Second Chance; a similar result was reached by the Court of Appeals in the related case of Dobrowolski v. Second Chance Body Armor, unpublished opinion per curiam, issued June 3, 2003, No. 238007. The Supreme Court disagrees with appellant's position that the two Court of Appeals opinions are necessarily inconsistent. Both opinions are consistent with this Court's opinion in Rogers v. J B Hunt Transport, Inc, 466 Mich 645, 650-651 (2002), in which the Court held that an employer is responsible to third parties for the wrongful acts committed by an employee while performing some duty within the scope of employment.
