Opinion
Gen. No. 42,072. (Abstract of Decision.)
Opinion filed July 1, 1942
CORPORATIONS, § 627 — as to diligence required in stockholder's suit. In an action by a minority stockholder in a corporation to establish that shares of stock in another corporation held by defendants were the property of plaintiff's company, the allegations in the complaint were insufficient to state a cause of action, and also showed a lack of diligence in plaintiff in asking relief from a court of equity, and the complaint was properly dismissed.
