Sandra S. WILCOX WILLIAMS SMITH, Appellant v. THE COUNTY OF GUADALUPE, Appellee

From the 25th Judicial District Court, Guadalupe County, Texas Trial Court No. 20-0818-CV Honorable William D. Old III, Judge Presiding

ORDER

Liza A. Rodriguez, Justice

On June 21, 2023, we ordered appellant to provide a reasonable explanation for filing her notice of appeal after the deadline but within the fifteen-day grace period allowed by Rule 26.3 of the Texas Rules of Appellant Procedure. See Tex. R. App P. 26 3; Verburgt v. Dorner, 959 S.W.2d 616, 617 (Tex. 1997). A reasonable explanation is any plausible statement of circumstances indicating that the failure to timely file the notice of appeal was not deliberate or intentional, but was the result of inadvertence, mistake, or mischance. Hone v. Hanafin, 104 S.W.3d 884, 886 (Tex. 2003). Appellant responded to our order, explaining that her notice of appeal was late because of medical issues, vandalism of her documents, and "tech equipment" problems. Appellant's explanation is reasonable. We, therefore, GRANT the motion for extension of time and ORDER this appeal retained on the court's docket.

The appellate record has been filed. Therefore, appellant's brief is due on or before September 14 2023.
