JOSEPH TODD SMITH, Appellant v. THE STATE OF TEXAS, Appellee

On Appeal from the 366th Judicial District Court Collin County, Texas
Trial Court Cause No. 366-80590-2016

ORDER

On September 27, 2017, appellant tendered his brief along with his second motion to extend time to file his brief. Although appellant generally refers to the victim by her initials, in at least one instance, he refers to her by name. Accordingly, we STRIKE appellant's brief.

We ORDER appellant to tender, within TEN DAYS of the date of this order, an amended brief that does not identify the child victim by name in any portion of the brief.

We DIRECT the Clerk to send copies of this order to Lara Bracamonte and the Collin County District Attorney's Office.

We will defer ruling on the motion for extension of time until the amended brief is received by the Court.
