JOSEPH TODD SMITH, Appellant v. THE STATE OF TEXAS, Appellee

On Appeal from the 366th Judicial District Court Collin County, Texas
Trial Court Cause No. 366-80590-2016

ORDER

Before the Court is appellant's August 21, 2017 third motion for an extension of time to file appellant's brief. We GRANT the motion. We ORDER appellant's brief filed by September 20, 2017.

Appellant's brief was originally due March 19, 2017. We granted two extensions to appellant totaling more than sixty days. On June 23, 2017 we abated the appeal for a hearing to determine why appellant's brief had not been filed. By order dated July 20, 2017 we reinstated the appeal and granted appellant an additional thirty days to file his brief.

If appellant's brief is not filed by September 20, 2017, the Court will enter an order removing counsel and ordering the trial court to appoint new counsel to represent appellant.
