Opinion

No. 05-05-00383-CR

Opinion Filed August 10, 2005. DO NOT PUBLISH. Tex.R.App.P. 47.

On Appeal from the County Court at Law, Kaufman County, Texas, Trial Court Cause No. 04CL-0465. Dismiss.

Before Justices O'NEILL, RICHTER, and FRANCIS.

MEMORANDUM OPINION

Stanley Smith was convicted of driving while intoxicated. Punishment was assessed at sixty days' confinement in the county jail and a $750 fine. We adopted the trial court's findings that appellant has abandoned the appeal and has not made arrangements to pay for the clerk's or reporter's records. Because no clerk's record has been filed, we dismiss the appeal for want of prosecution. See Tex.R.App.P. 37.3(b).
