No. 05-08-00817-CV

Opinion Filed January 15, 2009.

On Appeal from the County Court at Law No. 1, Dallas County, Texas, Trial Court Cause No. cc-03-11122-A.

Before Chief Justice THOMAS and Justices O'NEILL and MURPHY.

MEMORANDUM OPINION

Appellant Kelvin Smith's brief was due by November 30, 2008. When appellant had not filed his brief by December 11, 2008, we sent a letter to appellant directing him to file a brief and an extension motion that complies with Tex. R. App. P. 10.1(a) and 10.5(b) within ten days. We warned appellant that if his brief and an extension motion were not filed by the deadline, the appeal would be dismissed. Nevertheless, to date, appellant has not filed a brief.

Accordingly, we DISMISS the appeal for want of prosecution. See Tex. R. App. P. 38.8(a)(1), 42.3(b) and (c).
