In lieu of granting leave to appeal, the judgment of the Court of Appeals dated October 31, 1997, is vacated, and the case is remanded to the Washtenaw Circuit Court for reconsideration of the summary disposition motions in light of MCL 211.43 1; MSA 7.661 and Dow v. Michigan, 396 Mich. 192, 197, n 9 (1976). MCR 7.302(F)(1). Jurisdiction is not retained. Court of Appeals No. 199498.
