Court of Appeals of Texas, Fifth District, Dallas
Jan 4, 2007
No. 05-06-00809-CV (Tex. App. Jan. 4, 2007)

Opinion

No. 05-06-00809-CV.

Opinion issued January 4, 2007.

On Appeal from the 160th Judicial District Court Dallas County, Texas Trial Court Cause No. 05-12649.

Before Justices WRIGHT, BRIDGES, and MAZZANT.

MEMORANDUM OPINION

On June 12, 2006, appellants filed a notice of appeal in this case. On that same day, we notified appellants by letter that the $125 filing fee was due. We gave appellants ten days to pay the filing fee. On September 15, 2006, appellants filed in this Court a motion to reconsider pauper's affidavit on appeal. The trial court sustained a contest filed in response to appellants' request to proceed without payment of costs. After receiving and reviewing the reporter's record of the hearing on the contest conducted in the trial court, on November 15, 2006, we denied appellants' motion to reconsider and ordered appellants to pay the $125 filing fee within ten days of the order. We cautioned appellants that if they failed to comply with our directives within the time allowed, the appeal would be dismissed without further notice. Nevertheless, to date, appellants have not paid the filing fee.

Accordingly, on the Court's own motion, we DISMISS the appeal. See Tex. R. App. P. 5, 42.3(c); Appendix to the Tex. R. App. P. (B)(1)(a).
