MEMORANDUM OPINION


The Court has before it the parties' August 6, 2008 joint motion to dismiss. The parties state in their motion that all matters in controversy between them have been settled and compromised to their satisfaction and they jointly move the Court to dismiss this action. Further, the parties request cost be paid by "the party incurring same." The Court GRANTS the motion and dismisses this appeal. See Tex. R. App. P. 42.1(a)(2). Each party is ordered to bear its own cost on appeal.
