Opinion

No. 05-07-01757-CV

Opinion issued January 7, 2011.

On Appeal from the County Court at Law No. 3, Dallas County, Texas, Trial Court Cause No. CC-06-18320-C.

Before Chief Justice WRIGHT and Justices O'NEILL and MYERS.

MEMORANDUM OPINION

On December 10, 2010, the Court ordered the Dallas County Clerk to file, within ten days, either the clerk's record or verification that appellants have not paid for the record. We warned appellants that if we received verification of non-payment, we would dismiss the appeal without further notice. See Tex. R. App. P. 37.3(b). On December 21, 2010, we received a letter from the Dallas County Clerk stating appellants have not paid for the record, and appellants have not given the Court proof of payment. Accordingly, we dismiss the appeal for want of prosecution.
