          JUDGMENT

         On October 12, 2004, the court granted the motion for summary judgment filed by Defendants and Cross-Complainants.¹ On November 12, 2004, this court issued an order dismissing the counterclaim for declaratory relief to the extent it sought a declaration that the patent-in-suit is invalid, void and/or unenforceable. Therefore,

         IT IS HEREBY ORDERED that judgment of non-infringement be entered in favor of Defendants and Cross-Complainants, and that Plaintiff take nothing by way of it's complaint.
