This is an accelerated appeal from the denial of Appellants' motion to compel arbitration. See Tex. Civ. Prac. & Rem. Code Ann. § 51.016; Tex.R.App.P. 28.1(a). On November 7, 2022, Appellants filed an "Emergency Motion to Stay Trial Court Proceedings Pending Appeal." In our November 29, 2022 order, we granted Appellants' motion and stayed all proceedings in the trial court.
Appellee filed a "Motion to Lift Stay for Limited Purpose" on March 22, 2023. In its motion, Appellee states that it "agrees to arbitrate its claims against Appellants" and asks that we "lift the stay to enable the trial court to enter an order compelling arbitration." Appellee separately filed a "Certificate of Conference" stating that Appellants are unopposed to the motion to lift stay.
Appellee's motion is GRANTED. The stay imposed by this Court on November 29, 2022 is lifted for the limited purpose of enabling the trial court to enter an order compelling arbitration. We set aside the trial court's October 27, 2022 order denying Appellants' motion to compel arbitration without regard to the merits and remand this cause to the trial court for effectuation of the parties' agreement to arbitrate.
The appeal is abated, treated as a closed case, and removed from this court's active docket until July 3, 2023. The appeal will be reinstated on this court's active docket at that time, or when the parties file a motion to dismiss the appeal or other dispositive motion. The court will also consider an appropriate motion to reinstate the appeal filed by any party, or the court may reinstate the appeal on its own motion.
