MEMORANDUM AND ORDER PURSUANT TO RULE 1:28

Based on the arguments and authorities set forth in the defendants' memorandum in lieu of brief at pages three through eight, we affirm the judgment and the order denying the motion for relief from judgment.

The motion to submit a memorandum in lieu of brief is allowed.
