Stephen SISTRUNK v. FLORIDA MARINE, LLC and Florida Marine Transporters, LLC


Writ application denied.

Hughes, J., would grant and assigns reasons.

Hughes, J., would grant the writ.

I would grant the writ and reinstate the ruling of the trial court. The trial judge is to consider the "manner, conditions, and scope" of the examination. This case is not like Henry v. Barlow . No attorney would be present. Like body cams for police officers, a recording in this case would simply serve the truth. In any event, there is nothing to prevent the applicant from being accompanied at the examination by a friend or family member.
