LATRAVIAN VANCHAN SIMS, Appellant v. THE STATE OF TEXAS, Appellee

On Appeal from the County Court at Law Panola County, Texas Trial Court No. 2020-C-146

Before Stevens, C.J., van Cleef and Rambin, JJ.

ORDER

Appellant Latravian Vanchan Sims appeals from the trial court's judgment revoking his community supervision and sentencing him to eight years' imprisonment for aggravated assault with a deadly weapon. On February 12, 2024, Sims's court-appointed appellate counsel filed an Anders brief in this appeal, and on February 26, 2024, Sims filed a pro se motion for access to the appellate record for purposes of preparing a response to that Anders brief. We grant Sims's motion for access to the appellate record. Under Kelly v. State, we are now required to enter an order specifying the procedure to be followed to ensure Sims's access to the record.

See Anders v. California, 386 U.S. 738 (1967).

Kelly v. State, 436 S.W.3d 313, 321-22 (Tex. Crim. App. 2014).

On February 26, 2024, Sims's appointed counsel informed this Court that she had provided a paper copy of the appellate record to Sims. Allowing ten days from the date of this order for the record to be delivered to Sims and giving Sims thirty days to prepare his pro se response, we hereby set April 16, 2024, as the deadline for Sims to file his pro se response to his counsel's Anders brief.

IT IS SO ORDERED.
